A bar has opened under my flat. It used to be a shop and tea room. We have had a premise licence review. The Council only reduced the time by 1 hour to 11pm. What else can I do?
Have you made enquiries as to the planning situation? Are there any restrictions on land-use category or conditions on trading hours? Rules have changed but it used to be the case that if a shop wished to change category (e.g. from A1 retail use to a bar) they would require permission. The EHO could advise the planning authority whether the proposal was suitable, recommend it be turned down or recommend additional measures were implemented (commonly improved sound insulation between the commercial and domestic properties is necessary where changes like this are made; it is surprising that this was not considered at the review hearing).
